Anyone who wants to play with a bath with a pool to set up in their own garden needs to take into account a few things. Two experts explain what is important.
Summer time is bath time. If you want to bypass the lake or pool, you can bring the fun of bathing home in your own garden with a ground pool. Katja Tölle, deputy editor-in-chief Öko-Test-Magazine, and Roman Sostin, attorney at Haus und Grund Bayern.
Unlike a conventional swimming pool, an above-ground swimming pool is not permanently integrated into the garden. This means it can be dismantled or moved if space is otherwise needed. The classic inflatable paddling pool also belongs to the category of above-ground pools.
However, in particularly dry summers, you may not be able to enjoy your own swimming pool for long, as refilling may be prohibited. This has already happened in the municipality of Grävenwiesbach in Hesse. In the summer of 2020, there was a ban in North Rhine-Westphalia. The managing director of the German Association of Towns and Municipalities, Gerd Landsberg, warned earlier this year that filling the swimming pools could become a problem.
What is the price range for above-ground pools?
Above-ground pools come in all shapes and sizes and with different functions. Accordingly, prices can vary considerably. “There are models for € 60 or € 70 that are better for a paddling pool,” says Tölle, “and luxury pools for € 1,000 or more.”
Can anyone set up a ground pool in the garden?
While homeowners can simply put up an above-ground pool in their garden, things are more difficult for tenants, explains Tölle. “If they rented a garden for exclusive use, some courts have in the past considered that this also allowed them to set up swimming pools.” However, if the garden is to be used jointly, an agreement must be reached with the other tenants and the owner. If you also talk and agree with the landlord or landlord, you are always on the safe side.

In the case of a condominium, it is usually the case that there is a so-called special right to use the garden, says lawyer Sostin. “The homeowners’ association might have a say if I want to have a pool like this,” he explains. There have already been court rulings in this case, according to which the overground pools had to be dismantled again. One argument was that the pool disturbed the impression of the entire apartment complex too much and therefore had to be removed again.
It’s often enough to look at the lease or house rules, says Sostin. If the opening of the pool is expressly prohibited, you are “back there”. When using the pool, you must not disturb the neighbors – he explains. This means it shouldn’t be too loud and you need to obey silence.
What should be included in the construction law?
For most of the smaller above ground pools, you don’t need a permit and you don’t need to follow any other safety precautions under building law. If you want to be sure, ask the competent building office, laws vary by state. “As soon as I have to lay some lines, it’s a good idea to ask the municipality,” says Sostin.
What hygiene measures do users have to take?
If the water stays in the pool for a long time, it becomes dirty. As in any other body of water, algae accumulate there and the water becomes discolored. But this is only possible if the water does not contain any chemicals.
Alternatively, pool water can be kept clean with chemicals such as chlorine, which is also used in pools. In such cases, however, it is important that the water is disposed of properly when emptying the pool.
How to get rid of chlorinated water?
If you keep the pool clean with chemicals, you can’t just pull the cork out. You simply mustn’t let the chlorinated water run off in the garden. It is also not suitable for watering plants, as it would endanger them and soil organisms, and could also contaminate groundwater, explains Tölle. Pool water with additives such as chlorine or biocides must be discharged into a sewage system, via a combined sewer system or alternatively by a sewage disposal company.
What safety regulations do you have to follow?
As the owner of an above-ground pool, you have a duty to care for public safety, explains Sostin’s lawyer. This means that you need to take the necessary safety measures so that others are not harmed by the pool.
This is especially true for children. “Of course, you should never let children play alone in the water, but that’s obvious,” says Tölle. To prevent children from simply entering the pools unsupervised, it is a safety rule that they must be kept out of reach of them. Either the property with the pool is fenced and no one has access to it, or the owner installs a security fence around the pool. A hard cover is also an option if the kids can’t open it.
